Arkansas Attorney General’s Office pays out $1.1 MILLION settlement for alleged “false imprisonment” of 246 patients by psychiatrist Dr. Brian Hyatt

An Arkansas psychiatrist was apparently running a Medicaid scheme to hold people as long as possible, against their will, for weeks on end, while they received no medical care at all. Relatives of patients had to show up with lawyers, court orders, and sheriff’s deputies to force Dr. Hyatt to release them. Northwest Medical Center was also unable to provide documentation justifying all these patients who were held against their will far longer than the 72 hours the doctor was allowed to hold any of them, and that would be only if he deemed them a danger to themselves or to others.

Allegedly, Dr. Brian Hyatt was holding these patients as long as possible in his unit, while billing Medicaid at the fullest extent he could. More than two dozen of these patients are suing him, and this could be a domino effect where many more incidents and cases come to light. Dr. Hyatt neither had a court petition or consent of a judge to hold any of these 246 patients for more than 3 days.

Supposedly, Hyatt is one of the most prominent psychiatrists in Arkansas, but not so much anymore, now that he’s under investigation by state and federal authorities for Medicaid fraud and false imprisonment. A search warrant affidavit reveals that Dr. Hyatt was billing Medicaid for weeks on end for patients he held against their will and billing Medicaid at the “highest severity code” possible for every patient. Sounds like he’s busted red-handed now.

In the face of all of this, the doctor and the hospital claim to have done nothing wrong at all, which would basically mean that any doctor or hospital in Arkansas can hold any patient against their will indefinitely without any documentation saying they have mental problems or are a danger to anyone. This would mean it is legal to kidnap people in Arkansas, as long as they are held at a hospital by a doctor who says he’s not doing anything wrong. The hospital says they “undertook a number of actions to ensure our patients’ safety….” meaning their captives were protected from harm. Nothing to worry about here!

Dr. Hyatt claims now that he is the “target of a vicious, orchestrated attack” on his character and service. Talk about conspiracy theories. That would mean 246 of HIS patients all got together and made up a whole story about how they were all held against their will at his unit in the hospital, and that they’re all liars just trying to get him in trouble. Sure. Hyatt says he’s looking forward to the court cases. Wait, what?

Staff members of Dr. Hyatt have a different story, saying Hyatt rarely even saw these patients, and when he did, it was only for a few short minutes, here and there, just to make an appearance. This is also backed up by security surveillance footage, revealing that Hyatt never even had a single conversation with the vast majority of patients under his care. Oops.
