New York Attorney General (AG) Letitia James has instructed hospitals across the state to continue performing sex-change procedures on minors, despite President Donald Trump’s recent executive order (EO)  aimed at banning such practices.

Trump signed the EO titled “Protecting Children From Chemical and Surgical Mutilation” on Jan. 28. It seeks to end federal funding for hospitals and medical institutions that provide puberty blockers, hormone therapies, or surgical interventions to minors under the age of 19. The order frames these treatments as irreversible and harmful, accusing medical professionals of “maiming and sterilizing impressionable children” under the guise of “gender transition.”

However, James has fired back – warning hospitals that compliance with Trump’s EO would violate New York’s anti-discrimination laws. In a letter sent to healthcare facilities, she emphasized that denying services to transgender individuals based on their gender identity or diagnosis of gender dysphoria while offering the same services to so-called “cisgender” individuals constitutes illegal discrimination under state law.

James’ directive underscores the Empire State’s commitment to protecting “transgender rights,” even as other states and institutions begin to scale back or eliminate gender-affirming care programs in response to Trump’s order. Hospitals in Colorado, Illinois, Pennsylvania, Virginia and Washington, D.C. have reportedly started canceling appointments for minors seeking transgender treatments. At the heart of the issue is the question of whether minors can meaningfully consent to life-altering medical interventions. On the one hand, opponents of such procedures argue that children are too young to fully understand the long-term consequences of treatments like puberty blockers and surgeries, which can lead to irreversible changes in fertility, bone density and cognitive function. On the other hand, advocates argue that withholding treatment can cause significant psychological harm to transgender youth.

Dr. Marc Siegel, a senior medical analyst for Fox News, has been vocal about the potential risks of these treatments. “Puberty blockers like Lupron interfere with bone growth and can impact fertility and cognition when combined with hormones,” he explained. “Surgical interventions such as mastectomies or genital surgeries are irreversible and should never be performed on children.”

The legal and ethical battle over transgender care for minors is further complicated by the broader political landscape. New York has positioned itself as a progressive stronghold, with Democratic Gov. Kathy Hochul recently signing legislation to protect abortion providers and women seeking abortions.
