Where there’s a will, there’s a way: Ohio Senate overrides Gov. Mike DeWine’s veto of bill that bans transgender drugs and surgery for minors

The Ohio Senate successfully overrode the veto of Republican Governor Mike DeWine, who rejected a bill that bans transition-related medical care for transgender minors and restricts the participation of trans athletes in sports competitions for girls.

House Bill 68, set to take effect in the next 90 days, received 23 votes in favor and nine votes against by the members of the Senate. The bill, which was vetoed on December 29, 2023, originally received an initial 65-28 vote in favor from the Ohio House of Representatives.

The legislation, which includes the Save Women’s Sports Act and the Saving Adolescents From Experimentation Act, prohibits the prescription of puberty blockers, hormone therapy and gender-affirming surgeries for minors with gender dysphoria. The bill also bans males who identify as females from participating in female athletics. Physicians who continue to provide such care to minors risk losing their medical licenses. (Related: Ohio House of Representatives upholds trans surgery ban for minors, overrides DeWine’s veto.)

Moreover, the law empowers students to sue educational institutions or organizations if they believe they have been deprived of athletic opportunities due to the participation of transgender students.

Ohio has now become the 24th state to block transgender girls and women from participating in girls’ sports at the high school and college levels and the 22nd state to restrict minors from access to puberty blockers and hormone therapy.

Sen. Kristina Roegner: There is no such thing as gender-affirming care

The controversial legislation has sparked heated debates, with critics arguing that it infringes upon the rights and well-being of transgender people.

Dara Adkison, the secretary of the board for the transgender advocacy group TransOhio, reported that some trans individuals and their families are in crisis, seeking emergency funding and relocation assistance due to the unfavorable political climate.

“Their government is forcing them to uproot their lives. The intense amount of personal and community trauma that is being inflicted by the government right now and putting these families through who just love their f—ing kids is so cruel,” Adkison stated.

Major medical associations, including the American Medical Association, the American Academy of Pediatrics and the American Psychological Association, also support minors through access to gender-affirming care and their opposition to state-imposed bans.

However, healthcare experts from other countries criticize these organizations, calling them unethical and more focused on politics than medicine. The U.S. stands out politically among Western nations on this issue, as countries like France, the U.K. and Sweden have halted puberty-blocking treatments and surgeries for minors due to concerns about long-term effects.

Some young Americans who underwent gender-affirming surgeries, including a young man named Kobe, are expressing regret for being castrated, realizing he was a gay boy who liked playing with Barbies, not a woman. Additionally, Kayla Lovdahl from California is suing Kaiser Permanente, claiming she was pressured into transitioning and having breast removal surgery, while Luka Hein from Minnesota is suing a doctor for performing a breast removal surgery when she was just 16.

Furthermore, State Senator Kristina Roegner, a co-sponsor of the bill, argued ahead of the vote that gender cannot be changed. She dismissed the concept of a gender spectrum and claimed that gender-affirming care is a nonexistent term.

“There is no such thing as gender-affirming care. You can’t affirm something that doesn’t exist. This is quite a profit center for those hospitals pushing these procedures to teenagers, (and) children. They’re not capable of making life-altering decisions.”
